The General Conditions presented here are subject to the provisions of Law 7/1996, of 15 January, on the Regulation of Retail Trade; Law 7/1998, of 13 April, on General Terms and Conditions; Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Protection of Consumers and Users; Law 34/2002 of 11 July, on Information Society and Electronic Commerce Services; and Organic Law 3/2018 on Protection of Personal Data and Guarantee of Digital Rights.

Contract

The user declares that he or she is of legal age (over 18 years old) and has the legal capacity required to enter into contracts. They also accept the above-mentioned conditions in their entirety, insofar as they do not contradict current legislation, to use this website and to purchase the products. Were any clause included in these general terms and conditions to be declared totally or partially null and void, such nullity shall only affect that provision or the affected part of it and shall be deemed not to have been included. These Terms and Conditions describe the terms applicable to the services and contents offered on the web site www.ferroslapobla.com and regulate the legal relations between FERROS LA POBLA S.A. and the customer. Access to the website is open and free of charge, and the use of the website implies unreserved acceptance of all the Terms of Use. Should you not agree to these conditions, you must refrain from using this site.

The user must visit the eCommerce website responsibly and following current legislation and these Conditions, with good faith and respecting the intellectual and industrial property rights owned by FERROS LA POBLA S.A. or any other natural or legal persons.

The use of any of the contents of the website for purposes which are or may be unlawful is strictly prohibited, as is any action which causes or may cause damage or alterations of any kind to the eCommerce website or its contents not consented to by FERROS LA POBLA S.A.

The website and the products and services offered by FERROS LA POBLA S.A. are intended for persons of legal age with sufficient legal capacity to be bound by these Terms of Use. It is possible that the use of certain services or the purchasing of certain goods or services may be subject to special complementary conditions that will require express consent and that shall prevail over these general conditions in all cases.

The customer shall be solely responsible for the safekeeping and confidentiality of their password, so it shall be understood that any third party who may use it does so with the consent and on behalf of the customer.

User Registration

The use of the services provided by FERROS LA POBLA S.A. and purchases on the Website require the user to be registered on the Website. In order to complete the registration, a series of personal data must be truthfully and accurately provided. If the customer wishes to register, they must select a username and a password, which are security elements that allow them to make purchases in the shop and that facilitate their identification for later purchases, the listing of their purchase history and accessing it. This data is confidential and for personal and non-transferable use only. Once you have registered, the website will send you a confirmation of registration to the e-mail address you provided.

1. Select the products you want and add them to your shopping cart. Once inside the webpage of the product, you can discover its features and choose. 
2. Once you have everything you want, you may add it to the shopping cart using the “Add to cart” option. Go to “My cart” at the top right of the screen and check the status of the cart (selected products, desired units, price per unit, taxes to be added, subtotal and total).
3. Click here to access your cart or to place an order.
4. Check the products and amounts you are buying and click on the “Order” button. 
5. Confirm the shipping and billing address (when necessary).
6. Enter your credit or debit card details to confirm payment for the selected products (Visa, MasterCard, Visa Electron or similar). 
7. Once the purchase has been made, the customer will be sent a confirmation of the purchase to the provided e-mail address, which will serve as proof of payment, including the order number and all the data of the purchase: product, price, taxes, and shipping costs (if any). The customer can check the status of the order at the purchase history link.

Product Information and Availability

The products that can be purchased in the shop are those that, together with their essential characteristics and price, are published in the Shop at any given time. Before confirming the order, you will also see the shipping costs that apply according to these terms and conditions. The price of each product will always be shown in euros and the corresponding taxes will always be included. In the event that the Shop detects a mistake in the price of the products, the customer will be informed of this incident and be given the option of confirming the order at the correct price or cancelling it at no cost.

Sales products will be stated as such.

Prices may be subject to internal variations or variations due to external factors (depending on current market prices). In the case of pieces cut to size, the corresponding price per cut will be applied, including the value of the loss of material as a consequence of this process.

For products such as steel or raw materials, prices may vary greatly depending on the market situation. Once it has been paid for, it cannot be changed.

Transport and packaging are not included in the price. Packaging or Pallets, which will be used according to safety criteria in the handling of loads, are considered returnable. The price of the packaging will be charged on the invoice and paid on return. Packaging return will be coordinated through our customer service. Prices do not include taxes.

All orders and purchases in the shop are subject to availability at the time of purchase.

Shipments and Deliveries  

The price of each product will always be shown in euros and the corresponding taxes will always be included. In the event that the Shop detects a mistake in the price of the products, the customer will be informed of this incident and be given the option of confirming the order at the correct price or cancelling it at no cost.

The shop reserves the right to change the stated prices after prior publication in the shop. However, the rates in force at the time of placing the order in the Shop shall apply to each order.

FERROS LA POBLA S.A. is forced to deliver the goods purchased by the user to the address provided on the order form for this purpose. In the event of omission or error in the filling out of said data, FERROS LA POBLA S.A. shall not be liable for any inconvenience caused and the costs of re-delivery derived therefrom shall be borne by the user. Under no circumstances will deliveries be made to post office boxes or call centres.

Deliveries will be made exclusively within Spain (the peninsula, the Balearic Islands, and the Canary Islands) via our own transport platform or by a parcel delivery company. 

FERROS LA POBLA S.A. reserves the right to change the type of shipment and the company in charge of it, independently of what is stated in this section and as long as it is not in any way detrimental to the customer. 

The order placed by the User will be delivered within maximum 7 working days in the peninsula and 15 working days on the Balearic or Canary Islands, counting from the payment of the purchase; except for orders paid by bank transfer in which case the period will be calculated from the time of the issuance email of confirmation or receipt of the payment in the account of FERROS LA POBLA S.A. 

FERROS LA POBLA S.A. shall be responsible for the goods until they are received by the customer, except in the event that the customer expressly chooses a delivery method other than the one proposed, in which case the responsibility shall end when the goods are collected from the warehouse. 

In the event that, for reasons of force majeure, the delivery of the order was not possible within the established period, FERROS LA POBLA S.A. is committed to inform the user as soon as possible of the new delivery date, releasing FERROS LA POBLA S.A. from the commitment stated in the previous section. 

If the courier company is unable to deliver the product because no one is available to receive the shipment, the courier company will provide instructions to the customer to arrange a new delivery date. 

Upon receipt, the customer must check that the order matches the amounts and types of products ordered. 

Shipping costs for direct purchase on the WEBSITE 

• We only ship within 150KM distance from Ferros la Pobla S.A.
• Shipping costs are calculated as follows: Distance from Ferros to Postcode x2 (ROUND TRIP) x 1.82 (VAT INCLUDED).
• PLEASE NOTE: There is a minimum cost for a distance of up to 22km (TO THE POSTCODE AND BACK): 40€ + VAT will be charged.  

 Payment Methods

 The accepted forms of payment are the following:

• Bank transfer or through the PAYPAL platform.
• Payment by credit or debit card (Visa, MasterCard, Visa Electron, or other similar cards). This means of payment is made through the bank’s own payment gateway with its security protocols. 
• Payment by deposit in the bank account (proof of payment must be sent by email).
• Payment by BIZUM. 

The customer undertakes to pay once the order has been placed. The price that appears on the website for each of the products offered will be increased by the corresponding shipping costs.

The receipt or proof of purchase corresponding to the order will be sent to the e-mail address provided by the customer at the time of purchase. 

Approval of Goods (Returns)

Returns are not admitted without prior written authorisation from FERROS LA POBLA S.A. Were the customer to require examination prior to the delivery of the goods, this must be expressly stated in the purchase order. The inspection may be carried out at our premises and by our personnel, by personnel employed by the customer, or by third parties or expert appraisers, and the costs of such inspections shall be borne by the purchaser. The maximum period for carrying out the inspection is set at 5 working days from the date of notification, after which the seller will perform the examination. The material declared suitable at the inspection may not be subsequently rejected, and FERROS LA POBLA S.A. reserves the right to make the deliveries regardless of any complaints made by the purchaser.

RETURNS are not admitted if the material has been manipulated (cutting, welding, or folding), bearing in mind that in the case of returning the product FERROS LA POBLA S.A. reserves the right to value the product at the current price. The customer would have to bring the product back (the Bar) at 6M and as long as it is a measure in use. If the article has been expressly custom-made for the Customer, NO RETURNS WILL BE ACCEPTED. 

Cancellations or Modifications of Orders

These are subject to prior review of the order status. Any costs incurred as a result of such cancellation or modification of current orders shall be charged to the customer.

Complaints

Should the goods present visible defects, a complaint must be made within a maximum of 14 days of receipt. In the event of internal defects that are only noticeable when using the material, the purchaser must immediately stop the processing and contact our customer service department to obtain data or samples as quickly as possible so as to find the cause of the non-conformity. Details of the purchase as well as other technical details on material handling or part production must be provided. Notice of claims shall be given no later than 3 months after delivery. The Seller shall perform the necessary tests to determine the cause of the claim. Costs arising from handling, treatment or production processes carried out with the material are explicitly excluded from the claim. In accordance with our quality system, we collect and record suggestions and complaints from our customers in order to determine the causes and to improve our products and services.

Right of Withdrawal

Should the customer not be satisfied with their order for any reason, they have a period of 14 calendar days from the date of delivery to return the product. In order for the customer to exercise their right to withdraw from the purchase, all returned products must be in perfect condition and in their original packaging.

Please note that this right is strictly excluded for all custom-made articles (cut or folded to size). 

To exercise your right of withdrawal, you can contact us by clicking on the “Cancellation of Purchases” section below or send us an email at comercial@ferroslapobla.es including all the details of your cancellation request. Please note that in the event that you exercise this right of withdrawal, the shipping costs for the return of the goods shall be at your expense. 

Refunds

The refund shall not be made unless the items have been received and it has been verified that the user has performed no handling other than what is considered necessary to establish the nature, characteristics and functioning of the items. In such case, the refund period is 14 calendar days from the communication of withdrawal.

In case payment was made by bank transfer, the refund to the customer’s account shall be made as soon as possible once the cancellation request has been received and approved by FERROS LA POBLA S.A. In case payment was made by bank card, the refund shall be made to the same card.

Cancellation of purchases  

The User may cancel the purchase process for as long as the purchase has not been fully processed. In order to ensure the cancellation, it is advisable to contact FERROS LA POBLA S.A. immediately, by e-mail at comercial@ferroslapobla.es or by phone on 96 276 30 07.

Retention of Title  

The Seller reserves the title of the goods sold and/or delivered until the full payment of all goods due is fulfilled.

Taxes/Electronic Invoicing  

For residents of the European Union the prices include the corresponding Value Added Tax (VAT). 

By accepting these General Terms and Conditions, the Customer gives their consent to FERROS LA POBLA S.A. to issue all invoices arising from transactions made through this site in accordance with the rules for Electronic Invoicing in Spain.

Severability of Provisions

Should any clause included in these Terms and Conditions be determined totally or partially null and void, such determination shall only affect that provision, and the remainder of these General Conditions shall be considered severable and remain in force.

Governing Law and Jurisdiction

These terms and conditions are governed in accordance with Spanish Law. FERROS LA POBLA S.A. and the User agree to submit any disputes arising from the contracting of products or services covered by these General Terms and Conditions to the Courts of the address of the party responsible.
