1- Purpose and Acceptance of The General Terms and Conditions

The website www.ferroslapobla.com (hereinafter referred to as the “Site”) is an e-commerce website accessible via the Internet at the address www.ferroslapobla.com and open to any Internet user (hereinafter referred to as the “User”).

The Site allows the User to browse freely through its different pages without any implication of a commitment to place an order. The site allows the Seller to propose the sale of certain products as a suggestion to Users browsing the site.

For the application of these conditions, the User and the Seller shall be jointly referred to as the “Parties” and individually as the “Party”, and the User who has confirmed an order shall be referred to as the “Buyer”.

In accordance with the provisions of Spanish Law 59/2003 of 19 December 2003 on Electronic Signatures, you are hereby reminded that the validation of a delivery note as specified in Art. 4.3, found below, in these conditions, constitutes an electronic signature, which has the same value between the parties as a handwritten signature.

The User wishing to purchase through this Site declares that he or she is over 18 years of age. Minors must obtain prior permission from their parents, guardians, or legal representatives, who will be held responsible for all acts performed by minors in their care.

2- Products Marketed on This Website

All offers of the products displayed on the Site are limited to Peninsular Spain and the Balearic Islands.

In accordance with Art. 40 of Spanish Law 47/2002 on the reform of Law 7/1996 of 15 January 1996 on the Regulation of Retail Trade, and Spanish Law 34/2002 of 11 July 2002 on Information Society Services and Electronic Commerce, before placing an order, the Purchaser has the right to be informed on the Site of the essential characteristics of the products he or she wishes to order.

The photographs, graphics, and descriptions of the Products for sale do not have a contractual nature but serve illustrative purposes only and the Seller, who makes every effort to ensure that the colours of the products shown in the photographs displayed on the website are faithful to the original products, although variations may occur due to, in particular, the technical limitations of the colour possibilities of computer equipment, does not assume any liability.

The purchase offers, including promotions, are valid on the dates indicated on the website and depending on available stocks, which shall be indicated in each promotion.

3- Prices of Products and/or Services

The prices shown on this Site are in euros, and include the value added tax applicable at the time of the order. Any change in this tax will have an impact on the price of the products sold by the Seller on its Site, it being understood that the ordered products are invoiced at the prices in force at the time the order is placed.

Shipping costs are included and are invoiced following the price of the products purchased after the amount of the order. Shipping costs shall be detailed before the Buyer places the order.

4- Orders

The order is placed online by using a virtual “shopping cart”. Once the customer has finished adding the products to the cart, they are asked their relevant data (name, address, phone, shipping address and comments) and then move on to the payment process, which can be done by PayPal payment gateway, bank card, bank transfer or Bizum. Upon the payment being completed, the customer shall receive confirmation from the shop and a copy of the invoice (on request).

5- Payments

All orders will be paid in euros.

To pay for an order, the following means of payment are available: PayPal payment gateway, bank card, bank transfer or Bizum.

Accepted credit cards are Visa credit and debit, MasterCard and American Express.

The Buyer guarantees the Seller that he or she has the required authorisations to use the means of payment chosen at the time of placing the order.

The Seller has the right to suspend or cancel any order and/or delivery, whatever its nature and level of processing, in the event of failure to pay any amount owed by the Buyer or in the event of any payment problems.

In order to fight Internet fraud, payments relating to the Buyer’s order may be forwarded to the competent authorities for verification.

To ensure secure payment when using a credit card, the buyer will have to provide the CVV security code of the credit card. All data provided for this purpose will be encrypted to guarantee maximum security and confidentiality, and will be stored on a server certified by the SSL (Secure Socket Layer) protocol.

6- Orders Delivery

The products will be delivered to the Spanish address indicated by the Buyer when placing the order.

The order placed by the User will be delivered within a maximum of 7 working days on the peninsula and 15 working days in the Balearic or Canary Islands, counting from the payment of the purchase; except for orders paid by bank transfer in which case the period will be calculated from the time of the issuance email of confirmation or receipt of payment in the account of FERROS LA POBLA S.A.

7- Right of Withdrawal

The Seller shall accept to refund any item purchased on its Site if it is returned within 14 working days of receipt of the order. The shipping costs of returning the package shall be borne by the Buyer, unless there was a mistake in the reference number, or the product was defective.

The Products must be returned to the Seller in perfect condition for marketing (in their original packaging, perfectly sealed, unused, unbroken and with their tag).

If all these formalities are fulfilled, the refund will be made within 2 calendar days of receipt of the returned package and at the latest within 14 calendar days of the date on which the right of reimbursement was exercised.

8- Product Return and Refund. Instructions For Returning Products

Regardless of the reason for returning the products to the Seller, the Buyer is advised to follow these instructions in order to facilitate the processing of the return, as they shall be sent the appropriate transport company to collect the products. Any product that has been custom-made or ordered specifically for a customer cannot be returned.

9- Exemption from Liability

The Seller shall not be liable for the total or partial non-performance of this contract in the event of stock-outs or unavailability of a Product as a result of a force majeure event, of a total or partial strike —mainly of courier services, means of transport and/or communication—, except for promotions not intended to liquidate stocks.

The Seller accepts no liability of:

Any loss of data files on the part of the buyer, who must store the data with all due precautions.
Any Site service interruptions.
Any damage resulting from fraudulent intrusion by third parties involving the modification of the information provided on the Site.

and, in general, for any direct or indirect damages, whatever the causes, origins, nature or consequences, including loss of profits, customers, data and any other loss of intangible assets that may arise from accessing the site or from the impossibility of accessing it, as well as from the use of the site or from the credibility given to any information coming directly or indirectly from it.

10- Intellectual Property

In accordance with the legislation governing the ownership of intellectual and similar rights, this Site and all its elements, trademarks, designs, photographs, texts, illustrations, logos, animated or not animated content with or without sound, graphics, etc., as well as their compilation are the exclusive property of the Seller, who grants no licence or right other than the right to browse the Site. Reproduction or use of all or part of these elements for information purposes is only authorised for personal and private use. Reproduction and use of copies made for other purposes is expressly prohibited. The use, reproduction, duplication, copying, sale, resale, accessibility, modification, or any other exploitation, in whole or in part, of the Site, its content or trademarks is prohibited for any purpose, except with the prior written permission of the Seller (…)

Any other use shall constitute counterfeiting and shall be punishable under Intellectual Property Law unless prior written authorisation has been granted by the BRAND.
